Do not surprise anyone with bad roads in Ukraine. Many motorists cite the reason for this overloading trucks, which sometimes exceeds 100% or even 200% of the permissible weight. As it became known, the amount for the fine has been increased 50 times and now the maximum amount will be 34,000 UAH. The law has so far been submitted to the President for signature and will enter into force in the near future. Law No. 1047, on amending the size and weight control, was adopted by the Verkhovna Rada on September 11, 2019. If the President signs the relevant Law, then the new fines in case of overloading a truck will be from UAH 8500 to UAH 34000. Today, the current fine for violations of the weight of the cargo ranges from 510 to 680 UAH. (respectively, part 1 of article 132-01 of the Code of Administrative Offenses). Further distribution of new penalties:
- exceeding the permissible weight by 5-10% - a fine of 8500 UAH;
- from 10% to 20% - UAH 17,000;
- more than 20% - 34,000 UAH.
Regardless of who was driving the vehicle, the penalty for such a violation is imposed on the vehicle owner (legal entity or individual). If this rule is violated by a vehicle with a foreign registration, then the fine will be imposed on the person who imported this vehicle into the territory of Ukraine, that is, the driver. An amendment has also been made if the driver of the vehicle, passenger car or truck, ignores the request of a representative of the State Service to stop the vehicle for safety, a fine of 3400 UAH or deprivation of rights for a period of 3 to 6 months will be issued. It should be noted that the fixing of the permissible weight will be carried out automatically. Accordingly, a further fine will be mailed to the vehicle owner. If there is an e-mail or a mobile phone number in the database of the Ministry of Internal Affairs, the system will automatically send a duplicate of the fine.
If a citizen of another state refuses to pay a fine or an appeal against the decision in court may become the main reason for further refusal to enter the territory of Ukraine. The funds received from fines will be directed to the road fund for further restoration of the road surface. This law will also fall under this law for carriers who do not have a decision to move with cargo on highways and have no receipt for payment for the passage of a large-sized vehicle.
Also, vehicles with overload in accordance with the class of the car (dimensions in height and axle load) are received. Or the failure of drivers or a group of drivers carrying out the transportation of goods, or passengers of the inspector's requirements to stop the vehicle. Most likely, the law will be signed and will enter into force as soon as possible.
